This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.
ERA Fit is the coaching platform operated by ERA AI and made available at app.eraapp.ai. References in this Privacy Policy to "the Service" include the ERA Fit web application, the ERA Fit mobile applications and the www.eraapp.ai website.
We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Privacy Policy:
- Account means a unique account created for You to access our Service or parts of our Service.
- Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- Coach means a personal trainer, nutritionist, wellness coach or coaching business that uses the Service to deliver coaching services to Clients.
- Client means an individual who receives coaching services through the Service.
- Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to ERA AI, operated at www.eraapp.ai, which provides the ERA Fit platform.
- Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
- Country refers to: Florida, United States.
- Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
- Health and Fitness Data means information relating to Your physical condition, training, nutrition and wellbeing that You or Your Coach record in, or connect to, the Service.
- Personal Data is any information that relates to an identified or identifiable individual.
- Service refers to the ERA Fit web application, the ERA Fit mobile applications and the Website.
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
- Website refers to ERA AI, accessible from www.eraapp.ai.
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Collecting and Using Your Personal Data
Types of Data Collected
Personal Data
While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Phone number
- Address, State, Province, ZIP/Postal code, City
- Usage Data
Health and Fitness Data
ERA Fit is a health and fitness coaching platform. Depending on the features You or Your Coach use, We may collect and store the following categories of Health and Fitness Data:
- Body measurements and composition, including weight, body fat percentage and progress photographs
- Training and workout records, including exercises performed, sets, repetitions, loads and session history
- Nutrition records, including food and beverage logs, macronutrient and calorie intake, and meal plans
- Check-in responses, health questionnaires and assessments You complete
- Laboratory results and reports that You or Your Coach upload, which may include blood work, gut microbiome reports and genetic test results
- Supplement and medication information that You choose to record
- Data received from connected wearable devices and health platforms, as described under "Connected Devices and Third-Party Integrations" below
- Messages and notes exchanged between You and Your Coach through the Service
We collect this information in order to deliver the coaching service You have signed up for: to allow Your Coach to build and adjust Your programme, to display Your progress back to You, and to maintain a record of Your coaching history.
Where required by applicable law, We process Health and Fitness Data on the basis of Your explicit consent, which You may withdraw at any time by contacting Us or by deleting Your Account. Withdrawing consent may mean We can no longer provide some or all of the Service to You.
We do not sell Health and Fitness Data, and We do not use it for advertising or share it with advertising networks.
Coach and Client Relationship
Where You are a Client, the Coach or coaching business You have engaged is able to view the information You record in the Service, including Your Health and Fitness Data, so that they can deliver coaching to You. Where You are a Coach, You are responsible for handling Your Clients' information lawfully and in accordance with any agreement You have with them.
Usage Data
Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
Use of Google API Services for Calendar Integration
We utilize Google API Services for the "calendar" scope to enable users to add appointments from our website to their Google Calendar. We strictly use this API for the sole purpose of managing appointments created through our website/app. We do not share or read any of the user's calendar data beyond this specific functionality.
By using this service, you acknowledge and agree that your use and transfer of information received from Google APIs will adhere to Google's API Services User Data Policy, including the Limited Use requirements.
Meta Platforms (Facebook and Instagram) Integration
If You choose to connect a Facebook or Instagram account to ERA Fit, We use Facebook Login to obtain Your permission and to receive information from Meta Platforms. Depending on the permissions You grant, the information We receive may include:
- Your name, profile information and email address
- The Facebook Pages, Instagram business accounts and advertising accounts You manage
- Advertising performance data for Your own campaigns, such as spend, reach, impressions, clicks and results
- Content performance data for Your own posts, such as reach, engagement and follower counts
- Messages sent to Your connected Facebook Page or Instagram business account, where You have enabled that feature
We use this information for one purpose only: to display Your own marketing, advertising and content performance inside Your ERA Fit dashboard, so that You can review it alongside the rest of Your coaching business data.
We do not create, edit, publish or delete Your advertising campaigns. We do not sell information received from Meta, and We do not share it with third parties or advertising networks. Information received from Meta is retained only for as long as Your account remains connected, and access tokens are deleted when You disconnect.
You can disconnect a connected Facebook or Instagram account at any time from Admin > Integrations within ERA Fit. You may also remove Our access from Your Facebook account settings at facebook.com/settings?tab=applications. Disconnecting stops any further collection of information from Meta and removes the stored access tokens.
Our use of information received from Meta Platforms complies with the Meta Platform Terms and Developer Policies.
Connected Devices and Third-Party Integrations
The Service allows You to connect optional third-party accounts and devices. These connections are made at Your choice, and You can disconnect them at any time from within the Service. Where connected, We may receive:
- Oura — sleep, readiness, activity and related biometric measurements
- WHOOP — strain, recovery, sleep and related biometric measurements
- Apple Health and Android Health Connect — activity, workout, heart rate, sleep and body measurement data You choose to share
- Google Calendar — appointment scheduling, as described above
- Zoom — meeting links and scheduling information for coaching calls
- Meta Platforms — as described above
We also use Stripe to process payments. Payment card details are provided directly to Stripe and are not stored by Us.
Data received from these integrations is used to display Your information within the Service and to support the coaching relationship. It is not sold or used for advertising.
Tracking Technologies and Cookies
We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. The technologies We use may include:
- Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent.
- Web Beacons. Certain sections of our Service and our emails may contain small electronic files known as web beacons that permit the Company to count users who have visited those pages or opened an email and for other related website statistics.

Use of Your Personal Data

- To deliver coaching services: to allow Your Coach to build, adjust and monitor Your training, nutrition and wellbeing programme, and to display Your progress to You.
- For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
- To contact You: by email, telephone calls, SMS, or other equivalent forms of electronic communication regarding updates or informative communications related to the functionalities, products or contracted services.
- To provide You with news, special offers and general information about other goods, services and events which we offer.
- To manage Your requests: To attend and manage Your requests to Us.
- For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets.
- For analytics: data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service.
We may share Your personal information in the following situations:
- With Service Providers for monitoring and analytics.
- With Your Coach or coaching business, where You are a Client, so that they can deliver coaching services to You.
- For business transfers during mergers, sales, or acquisitions.
- With Affiliates who honor this Privacy Policy.
- With business partners to offer certain products, services or promotions.
- With other users when You share personal information in public areas.
- With Your consent for any other purpose.
We do not sell Your Personal Data.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.
Health and Fitness Data is retained for as long as Your Account remains active, so that You and Your Coach retain access to Your coaching history. When You delete Your Account, this data is deleted or anonymized as described under "Delete Your Personal Data".
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place.
Your Data Protection Rights
Depending on where You live, You may have the following rights in relation to Your Personal Data:
- Access — to request a copy of the Personal Data We hold about You.
- Correction — to ask Us to correct Personal Data that is inaccurate or incomplete.
- Deletion — to ask Us to delete Your Personal Data, as described below.
- Restriction and objection — to ask Us to restrict, or to object to, certain processing of Your Personal Data.
- Portability — to receive Your Personal Data in a structured, commonly used and machine-readable format.
- Withdrawal of consent — to withdraw consent You have given for processing, including for Health and Fitness Data, at any time.
If You are located in the European Economic Area or the United Kingdom, these rights arise under the General Data Protection Regulation (GDPR). Health and Fitness Data is treated as a special category of personal data under Article 9 of the GDPR and is processed on the basis of Your explicit consent.
If You are a California resident, the California Consumer Privacy Act (CCPA/CPRA) gives You the right to know what personal information We collect, to request its deletion, to correct inaccurate information, and to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under the CCPA.
To exercise any of these rights, contact Us at contact@eraapp.ai. We will respond within the time limits required by applicable law. You also have the right to lodge a complaint with Your local data protection authority.
Delete Your Personal Data
You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You. Our Service may give You the ability to delete certain information about You from within the Service. You may update, amend, or delete Your information at any time by signing in to Your Account and visiting the account settings section. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.
To request deletion of Your Account and all associated data, including Health and Fitness Data and any information received from connected third-party accounts, email Us at contact@eraapp.ai with the subject line "Data Deletion Request". We will confirm Your identity and complete the deletion within 30 days, except where We are required to retain certain records to comply with legal obligations.
If You connected a Facebook or Instagram account, disconnecting it from Admin > Integrations, or removing ERA Fit from Your Facebook account settings, deletes the stored access tokens and any information We received from Meta Platforms.
Disclosure of Your Personal Data
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
Law Enforcement
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities.
Other Legal Requirements
The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:
- Comply with a legal obligation
- Protect and defend the rights or property of the Company
